1. Products and Services
1.1 Art Prints and Reproductions: Macaco+ specializes in the sale of digital graphic art prints, including limited edition reproductions (e.g., Giclée, Risography prints) and specialized merchandise.
1.2 Limited Editions: Products designated as “Limited Edition” will have a defined maximum print run. Once the stated quantity is sold, no further prints of that specific edition will be produced by Macaco+.
1.3 Digital Representation: We make every effort to display the colors and details of our products as accurately as possible. However, the actual colors you see will depend on your monitor, and we cannot guarantee that your monitor’s display of any color will be accurate. Slight variations in color, texture, and cropping between the digital display and the physical print may occur.
2. Intellectual Property and Copyright
2.1 Ownership: The Service and its original content, features, and functionality are and will remain the exclusive property of Macaco+. All artwork, images, designs, logos, and written content on the Site are protected by copyright and intellectual property laws.
2.2 Permitted Use: The purchase of a physical print or merchandise does not transfer copyright or any right to reproduce the artwork. All purchased items are for personal display only.
2.3 Prohibited Use: You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any artwork or content on the website without express written permission from Macaco+ (contact: art.macacoplus@gmail.com).
3. Orders, Pricing, and Payment
3.1 Pricing: Prices for our products are subject to change without notice.
3.2 Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
3.3 Payment: All payments are processed through secure third-party payment processors (e.g., Stripe, PayPal). Macaco+ does not store or have direct access to your credit card details.
4. Shipping and Delivery
4.1 Shipping: We will ship to the address provided at checkout. The risk of loss and title for all products pass to you upon our delivery to the shipping carrier.
4.2 International Orders: The customer is responsible for any import duties, customs fees, tariffs, or taxes levied by the destination country. Macaco+ is not responsible for delays caused by customs processing.
5. Returns, Exchanges, and Refunds
5.1 Final Sale (Standard Prints): Due to the custom nature and careful packaging of art prints, all sales of standard prints and limited editions are final unless the item arrives damaged or defective.
5.2 Damaged Goods: If a product arrives damaged, you must notify us via email at art.macacoplus@gmail.com within seven (7) days of receipt, including photographic evidence of the damage to the product and the packaging. We will determine, at our discretion, whether to issue a refund or send a replacement.
5.3 Merchandise: Returns or exchanges for merchandise (e.g., shirts, mugs, phone cases) purchased through third-party fulfillment services (e.g., RedBubble) will be subject to the return policy of that specific platform.
6. Disclaimer of Warranties; Limitation of Liability
The Service and all products are provided ‘as is’ and ‘as available’ without any warranties of any kind. Macaco+ does not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free.
In no case shall Macaco+, its affiliates, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service.
